Pagyurak sa alaala ng patay at pag-justify sa EJK, labag sa RPC, Cybercrime Prevention Law

Ang pagyurak sa alaala at pagkatao ng patay, maging ang pag-justify o pag-suporta sa extrajudicial killings at alinmang labag sa batas ay may nakatakdang kaparusahan sa Revised Penal Code at RA 10175, o ang Cybercrime Prevention Act of 2012.

Ayon sa Section 6 ng Cybercrime Prevention Law:

“All crimes defined and penalized by the Revised Penal Code, as amended, and special laws, if committed by, through and with the use of information and communications technologies shall be covered by the relevant provisions of this Act: Provided, That the penalty to be imposed shall be one (1) degree higher than that provided for by the Revised Penal Code, as amended, and special laws, as the case may be.”

Sakop ng RA 10175 ang alinmang krimen na nakalista sa Revised Penal Code na ginawa sa internet, o sa alinmang technology devices. Mas pinabibigat pa ng Cybercrime Prevention Law ang parusa na nakasaad sa RPC.

Ang pag-justify o pag-suporta sa alinmang krimen o labag sa batas, katulad ng extrajudicial killings, ay labag sa RPC Article 154, na mas pinabibigatan pa ang parusa sa RA 10175.

Ayon sa RPC Article 154:

Unlawful use of means of publication and unlawful utterances. — The penalty of arresto mayor and a fine ranging from P200 to P1,000 pesos shall be imposed upon: (1) Any person who by means of printing, lithography, or any other means of publication (i.e. internet) shall publish or cause to be published as news any false news which may endanger the public order, or cause damage to the interest or credit of the State; (2) Any person who by the same means, or by words, utterances or speeches shall encourage disobedience to the law or to the constituted authorities or praise, justify, or extol any act punished by law.

Ang pagsira naman sa pagkatao o alaala ng isang patay ay labag rin sa batas.

Ayon sa RPC Article 353 (Libel):

A libel is public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause the dishonor, discredit, or contempt of a natural or juridical person, or to blacken the memory of one who is dead.”
